Our trust experience started with a dishonest estate lawyer who drew documents that allowed one trustee to sell properties without the co-trustee’s knowledge or permission. The co-trustee turned a blind eye to what was going on. After 9 months of watching this travesty, we hired an exceptional estate attorney, Jeremy Ofseyer in Palm Desert. After presenting the trustee’s fraudulent activities in probate court, the trustee was removed and Cindy Finerty was made sole trustee of the estate and was our fiduciary. What a blessing that was!!
Cindy was relentless in searching for all the trust assets, money, property, stocks and bonds. Monies had been diverted from the trust account, properties had been sold without any paperwork or notes and stock accounts had been cashed out. Rental income had been diverted from the trust to multiple bank accounts.
After two years of investigative work and accounting, Cindy was able find and inventory (154 pages) of all assets and make our half of the multi million dollar estate whole again and hold the original dishonest trustee liable for what was stolen.
Cindy was exceptional! She was kind to everyone involved. This was an extremely hard trust involving eight beneficiaries. She was unyielding in her quest to make sure everything was done legally and to all our satisfaction. She returned our calls and emails promptly and never failed to answer a question to our satisfaction. Cindy went above and beyond. We were truly blessed to work with such a excellent fiduciary and a wonderful person.
